Polygamy(Two wives) is not legal in Canada.

I married in a country where polygamy is legal,

I may have some rights under family law in Canada.

I am unsure about the status of my second marriage,

need advise please.

No you don't. Polygamy is not legal nor recognized in Canada. Your second marriage is not valid.

Even though polygamy is legal in the country where you married, your second marriage is still not recognized by Canada (because polygamy is not legal in Canada). In other words, from Canada's standpoint, your second marriage doesn't exist. Any rights under family law only apply to your first marriage.

I m separate from my first wife since 2008, and now we both agreed to proceed for divorce. However i married with my second wife in 2005 outside Canada and she is living till the day outside Canada with our two kids.
Please advise can i sponsor my second wife companied with my two kids to Canada after grant of divorce from my first wife.

No - you cannot sponsor your second wife at this time. Because you married your second wife before the divorce from your first wife was finalized, your second marriage is not valid from CIC's perspective.

To correct this situation you should first finalize the divorce with your first wife. Once the divorce is finalized, you should marry your second wife again to make your marriage valid. Only then will you be able to sponsor her.

"I may have some rights under Canada family law" i want to know these rights if any can support me in this situation.Becz..........from second wife i have two kids one of them is canadian citizen ,and other bornrned at that time when i was on PR.
If i go for re-marriage with my second wife,what will happen with my kid who is need to be canadian?

Hello Sidi,

You are right that the Marriage and Divorce publication from the Family Law Education for Women website does state,

"If you were married in a country where polygamy is legal, you may have some rights under family law."

It also states,

"This means that if your relationship ends, you will have some rights to child support, spousal support and property division.

If you are unsure about the status of your marriage, get legal advice"

You may want to speak to a lawyer regarding your situation if necessary. You can contact an Information and Referral Coordinator through the nearest Family Law Information Centre (FLIC). Information and Referral Coordinators are available at certain locations.
